  Terms and Conditions


iForm's POP is currently located in the Sydney 02 9 area. Calls made outside this zone may incur STD charges.
1 Charges and Billing
1.1 iForm's billing system works on a calendar month basis. ie. All accounts are billed from the 1st day of the month to the last day of the month.
1.2 Unused hours and unused megabytes are NOT carried over to the following month(s).
1.3 All billing occurs at the end of a session. eg. If you log on at 11pm, download 2 megabytes of data before midnight last day of the month, continue to use the session till 1am 1st day of the new calendar month, then this session (time and data) will be billed to the new month.
1.4 All data charges are calculated by the megabyte. 1 Megabyte is defined as 1,000,000 bytes.
1.5 All transactions will occur at the beginning of each month. This will consist of the plans minimum access fee for the month just entered, plus any overage fees from the previous month's access.
1.6 All accounts must have a balance of at least the minimum monthly charge for that account at the beginning of that month. eg. If an $11 per month account has a credit balance of $10.90 at the beginning of the month, this will be deemed insufficient to cover the minimum monthly charge and will be suspended without notification.
1.7 It is the customers responsibility to keep track of their balance. This can be done via our web site or calling iForm. All Cheque and Money Order payments must be paid in amounts of $50 or higher. Payments by cheque or money order of amounts less than $50 will incur a $3.30 Handling fee.
1.8 Accounts that fall into debt, will be suspended until payment and a re-connection fee is received.
1.9 A $5.50 re-connection fee applies to all accounts that have been suspended.
1.10 If a payment is rejected whether it be credit card, cheque or money order, the customers account will be notified and if a response is not received then the account will be suspended. The customer will be notified via mail and/or a telephone call if the account has not been settled within 60 days. Any costs incurred by iForm for rejected cheques, will be passed onto the customer.
1.11 Customers will be notified by email 4 weeks prior to commencement if any changes to the pricing schedule is to effect them.
1.12 Any account which is overdue by 60 days will be terminated automatically. This includes deletion of any emails we may be holding.
1.13 If at any time your usage of the service reaches an excessively high level, as determined by iForm, iForm may request immediate payment of usage charges incurred by you, and/or suspend the service until payment in full is received.
1.14 Download usage is calculated every calendar month, excess usage charges will be applied at the end of the month.
1.15 All invoices will be emailed to the customer. A printed and mailed invoice is available at $4.40 per invoice.
1.16 A customer may request to change their monthly plan at any time, however changes to customers monthly billing plans must be finalised by the 7th day of the month, for the change to take affect for that month. At this point, differences in the minimum monthly fee will be credited or debited accordingly.
1.17 Email box size is 10 Megabytes. Size can be increased for 55 cents per Megabyte per month.
1.18 If a multiple logon occurs with respect to a flat rate account (ie 5am-7pm or 7pm-7am) then the minimum charged for that month will equal the number of simultaneous connections multiplied by the standard monthly charge.
1.19 Usage is billed in 1 second increments and 1 byte increments.
1.20 If you do not log into iform through one of our access numbers, and instead access an iform hosted email address through a non iform connection (eg by another ISP/website), this will be classified as using an iForm service and standard monthly fees will apply.
2 Customers Obligations - Use of this Service
2.1 It is the customers obligation and responsibility to inform iForm of any change of address, contact numbers etc and of any changes to their credit card details.
2.2 It is the customers obligation to supply a residential or business address (other than a PO Box or Mail Bag etc) for access by the authorities if required, or debt collection if required.
2.3 It is the customers obligation and responsibility to regularly check their email for Invoice statements and important announcements. If the customer does not wish to view or use their allocated iform email address, then the customer must advise iform of an alternate delivery address.
2.4 The iForm mail servers will refuse delivery of inbound and outbound emails (where the iForm Outoing Mail server is used) that carry a virus package or attachment as detected by the mail servers Anti-Virus Scanning Software that iForm will maintain to be as up-to-date for Virus Definitions as possible.
2.5 The Anti-Virus Scanning Software by nature cannot detect new viruses that have not yet been recognised and included in Virus Definition Updates by the Anti-Virus Software Vendor. Nor can it be guaranteed to detect viruses/malicious packages that may be hidden in such a way as to be only targeting a specific Application (such as MS Outlook) that adversely interprets or modifies the package. The client accepts that it is still their responsibility to maintain the overall security level of their system/s by software settings, updates, patches, and service packs for their Applications and Operating System as released by their respective vendors.
2.6 iForm cannot be held responsible for any loss of service, data, hardware, income or costs incurred as a result of a virus/worm infection.
2.7 Emails left on the mail server (either not downloaded or where a copy is left on the mail server) for over 180 days will be deleted automatically by the mail server without notice.
2.8 A customer with a spam filtered email address accepts that emails originating from IP addresses blacklisted as known spam sources will be rejected by the Incoming Mail Server, and that this may prevent delivery of some legitimate email if originating from a blacklisted source.
2.9 iForm will decide the number and mix of publicly listed blacklists to incorporate as a basis for the Anti-spam filtering blacklist.
2.10 iForm will not be able to delist blocked IP addresses on an individual basis, and in such a situation, the intended recipient should advise the sender to seek alternative mail delivery methods (eg hotmail).
2.11 The ongoing filtering service and the initial migration to the filtered service shall be free of charge, however any change of mail servers by request of the customer afterwards may incur a setup fee.
2.12 You agree to keep your password confidential. You must notify iForm immediately if you lose your password or if it has been disclosed to anyone. You may change your password by contacting iForm at any time.
2.13 You represent that you are at least 18 years old and that you have the right and ability to enter into this Agreement.
2.14 You will be responsible for all access to and use of the Service through your account. You may permit another person, including a minor, to use your account but you assume all responsibility and liability for the activities that person conducts on-line and for any material to which that person is exposed.
2.15 You agree to supervise the use of your account by any minor or any other person who accesses the Service through your account.
2.16 iForm reserves the right to log you off the Service temporarily if you are idle (connected but do not actively use the Service) for any period exceeding 60 minutes.
2.17 iForm does not set session time limits.
2.18 The customer agrees to observe all relevant statutes, statutory regulations and by laws. iForm reserves the right to terminate this agreement at its discretion providing that 24 hours notice is given (Non-Payment see below) irrespective of whether such notice is written, verbal or in the form of electronic mail. iForm or any of its employees will not be held liable for any loss however caused resulting from the cancellation or suspension of services provided. In the event that the customer breaches any of the terms of this agreement iForm will immediately terminate all services provided without notification.
2.19 The customer agrees that iForm will in no way be responsible for any damage or losses incurred whether business or personal resulting from an interruption or quality of the service. The customer agrees not to send unsolicited email or mass postings on news groups and will only post advertisements in appropriate areas. iForm does not control or monitor information accessed and will not be held responsible for information accessed by you via this service.
2.20 You will not use the Service to obtain unauthorised access to any information, network or systems or to compromise the security or integrity of any network or system including any part of the iForm network.
2.21 You understand that the Internet contains viruses and other computer programs which may destroy or corrupt data on your own system. iForm has no control over such programs whatsoever and we do not filter the information passing through the Service in any way. You agree to check your own system for viruses on a regular basis. You must not place any viruses or other similar programs onto the Service or the Internet at any time.
2.22 If iForm considers it relevant to this application, iForm may obtain a credit report (which can include personal information about my/our credit worthiness, credit history credit standing or credit capacity) from a credit reporting agency. I/we understand that this information may be given and used to assess this application, to assess my/our credit worthiness, to assist me/us to avoid default and to notify other credit providers of any default by me/us. iForm may give a credit reporting agency certain personal information about me/us. This information includes (a) permitted details about me/us, (b) any payments which become overdue by more than 60 days and for which collection action has commenced, (c) that in the opinion of iForm, I/we have committed a serious credit infringement and, (d) that payments are no longer overdue or that credit provided by iForm has been discharged.
2.23 Any payments which become overdue by more than 60 days will incur an Over Due Account Service Fee of $150. This fee will be added to the existing debt. The total debt will then be registered with the Credit Reference Association of Australia and be passed onto a debt collection agency, where additional legal charges of approximately $500 or more can be added. Your account at this time will be terminated. This includes revoking dial up access, deleting your email account and any email within.
2.24 In the event that payment is not made by the specified date, iForm reserves the right to suspend a customer either temporarily or permanently from obtaining use of any of the services offered by iForm. The customer will then be liable to make payment of any outstanding liability. This agreement may be terminated by a customer providing that seven days written notice is given. iForm will not agree to release a customer from their liability until full payment is made in respect of services used. iForm will also not release a customer from liability should any of the terms and conditions in this contract be breached.
2.25 The customer accepts that on infrequent occasions they may experience a busy signal.
2.26 The customer may cancel this contract providing 7 days written notice is received by mail, fax, or email. Confirmation of the account password or last 4 digits of the credit card supplied to iForm, or signature must be provided in order to verify legal ownership of the account to be closed. It is the customers responsibility to confirm that iForm has received the cancellation request. This should be done by a verbal request. A $10 administration and handling charge will apply for any refund of remaining funds.
3 Support
3.1 iForm recommends a minimum system configuration of a Pentium 200 with 32 meg of ram running Windows 95 or higher. Support for slower machines is at iForm's discretion.
3.2 While we have 56k support, iForm does not guarantee that you'll connect at 56k due to line conditions, brand of modem, etc.
3.3 Help desk support is available to all iForm customers. For new accounts or where re-configuring is necessary for access to iForm, SETUP information is available on our Home Page under Local Support (www.iform.com.au). This information can be sent to you via fax or mail. After configuring your computer according to these documents, should you require any additional help then our Help Desk is available 9am-7pm Monday to Friday on 02 93887777. Out of hours help is also available via our Voice Mail.
3.4 Reoccurring or frequent support in which the customer has not followed the setup guide, or for services not pertaining to the connection or direct use of access to the internet, may attract a support fee of $11 per 15 minutes.
3.5 Customers with email problems, where the fault lies with the customers equipment and requires the transfer or removal of email(s) may incur an email administration charge of $3.30 per incident or per 20 emails cleared including email forwarding.
4 Customers Obligations - Legal Issues
4.1 You agree to indemnify and hold iForm harmless from all liabilities, damages, claims, actions, proceedings and expenses, including all legal fees and expenses, arising out of your use of the Service or your breach of any term of this Agreement in any way.
4.2 You may not assign or transfer any of your rights or obligations under this contract.
4.3 The customer accepts financial liability for any charges passed onto iform, directly from a regulatory body due to a complaint made by the customer that is determined to be unfounded or unsuccessful.
Trade names mentioned in this form belong to their respective owners. This form may be produced in Full but not in part. iForm reserves the right not to accept superceded forms or forms that have been altered without authorisation.
